| dc.description.abstract | Organ ve doku nakli, gelişen tıp ve tekniğin imkanlarıyla birlikte günümüzde en önemli ve etkili tedavi yöntemidir. Söz konusu alana etiğin ve tıbbın kayıtsız kalabilmesi mümkün değildir. Etik açısından pek çok konu, genel kabul gören etik ilkeler çerçevesinde tartışılmaktadır. Hukuk açısından ise her ülke, organ ve doku nakillerini düzenleyen kanunları oluşturmaktadır. Bu çerçevede ülkemizde de organ ve doku nakillerinin şartlarını düzenleyen temel kanun 2238 sayılı ODNK'dır. Söz konusu Kanun, genel hükümler bölümünün ardından, sağlararası organ ve doku nakilleri ile ölüden organ ve doku nakillerine ilişkin düzenlemeler getirmiştir. Organ ve doku bağışını teşvik edici düzenlemelerin karşılaştırmalı hukukta tartışılması karşısında, ülkemizde de konuyla ilgili tartışmalar yapılmakta ve yeni kanun tasarıları hazırlanmaktadır. Organ ve doku nakillerine ilişkin getirilen bu kurallara uyulmaması durumunda, bu durumun ceza hukuku açısından sonuçları, 5237 sayılı TCK'nın 91 ile 93. maddeleri arasında düzenlenmiştir. "Organ veya doku ticareti" başlıklı 91. maddede, farklı suç tipleri yer almıştır. Madde kapsamında, kişiden organ veya doku alma, ölüden organ veya doku alma, organ veya doku ticareti suçu, organ veya dokuyu saklama, nakletme veya aşılama suçu ile organ veya doku teminine yönelik olarak ilan veya reklam verme veya yayınlama suçu düzenlenmiştir. 92. maddedeki zorunluluk hali hükmü ile 93. maddedeki etkin pişmanlık hükmü ise yalnızca organ veya dokularını satan kimseler için getirilmiştir. | tr_TR |
| dc.description.ozet | With the developing medical and tecnical methods, organ and tissue transplantation is one of the most prominent and effective medical treatments. Ethics and law can not remain indifferent to this area. Ethically, many topics are debated within the framework of the ethical principles that are generally accepted. In terms of law, however, each country legislates the acts that arrange organ and tissue transplantations. Within this scope, the law about organ and tissue procurement, preservation, grafting and transplantation, no. 2238, is the main act that arranges the terms of organ and tissue transplantations in our country. Subsequent to general provisions, this act brings arrangements about the transplantations of organ and tissue from living and the transplantations of organ and tissue from cadaver. While arrangements that cheer the donation of organ and tissue are debated in compative law, discussions on this issue are made also in our country and new drafts of law are prepared. In case of violating the rules about the donation of organ and tissue transplantation, the consequences in terms of penal law are arranged in the Turkish Penal Code no. 5237, articles between 91 and 93. In the article 91 entitled "trading of organ and tissue", different types of crime are arranged. Within the scope of the article, the crime of organ and tissue procurement from living, the crime of organ and tissue procurement from cadaver, the crime of trading of organ or tissue, the crime of preservation, grafting and transplantation of organ and tissue, the crime of giving or publishing the announcement or advertisement of organ and tissue intended for the procurement of organ or tissue are arranged.
