| dc.description.abstract | Örnekleme (sampling), önceden var olan bir ses kaydının çeşitli unsurlarının, yeni bir esere dönüştürülmesinden oluşan bir müzik kavramıdır. Bu bağlamda, bir müzik eserinin örneklenmiş bölümleri özgünlükten yoksun olabilir. Bu şekilde ortaya çıkan eserler, önceki eser sahibinin haklarına müdahale eder ve dolayısıyla telif hakkı ihlaline neden olabilir. Buna rağmen örnekleme, çoğu zaman kullanıcılarca lisans alınması ya da dava riskinin göze alınması ile sonuçlansa da modern müzik üretiminde hala önemli bir rol oynamaktadır. Bu tezde, Amerika Birleşik Devletleri, Avrupa Birliği ve Türkiye'de müzik örneklemesinin yasal statüsünü karşılaştıracağız. Konunun anlaşılması için adil kullanım, de minimis doktrini ve pastiş istisnası gibi kavramları tartışacağız. | |
| dc.description.sponsorship | Sampling is a concept in music which consists of taking various elements of a pre-existing sound recording into a novel work. In this regard, sampled sections of a musical work may lack in originality, and may even interfere with the rights of copyright owner of previous sound recordings, thus result in copyright infringement. Yet, sampling still plays an important role in modern music production even though it usually either results in licencing fees or pose a litigation risk for the users. In this thesis, we will compare the legal status of music sampling in United States, European Union and Turkey. We will discuss concepts such as fair use, de minimis doctrine and pastiche exception for understanding the matter. | |
