| dc.description.abstract | Bu çalışmada yerleşme özgürlüğünün hukuki çerçevesi, anayasa hukuku açısından incelenmiştir. Çalışmanın birinci bölümünde yerleşme özgürlüğünün tarihsel gelişimi ve hukukça tanınmasına değinilmiştir. Çalışmanın ikinci bölümü ise yerleşme özgürlüğünün niteliği, işlevi, konusu, yararlanıcıları ve yükümlülerini içermektedir. Ayrıca bu bölümde yerleşme özgürlüğünün anayasal olarak olağan dönem ve olağanüstü dönemlerde sınırlanmasına ilişkin rejim ayrıntılarıyla incelenmiş ve yerleşme özgürlüğünün korunmasına dair hususlar irdelenmiştir. Bu değerlendirmeler Anayasa Mahkemesi ve Avrupa İnsan Hakları Mahkemesi kararları ışığında gerçekleştirilmiştir. | |
| dc.description.sponsorship | In this study, the legal framework of the freedom of settlement is analysed in terms of constitutional law. In the first part of the study, the historical development and legal recognition of the freedom of settlement are mentioned. The second part of the study includes the nature, function, subject, beneficiaries and obligors of the freedom of settlement. In addition, in this part, the constitutional regime regarding the limitation of the freedom of settlement in ordinary and extraordinary periods is examined in detail and the issues regarding the protection of the freedom of settlement are examined. These assessments are made in the light of the decisions of the Constitutional Court and the European Court of Human Rights. | |
