| dc.description.abstract | Çalışmamızın konusu "Türk Ceza Hukuku'nda İftira Suçu"dur. Bu suçla ilgili 5237 sayılı TCK döneminde yapılan çalışma sayısı sınırlı olduğundan, çalışmamızla iftira suçuna ilişkin teorik tartışmaları ve Yüksek Mahkeme uygulamalarını derleyip kendi görüşlerimizi ekleyerek ceza hukuku bilim dalına katkı sunmayı amaçlamaktayız. Bir başka amacımız da tartışmalı olan hükümleri ve bazı düzenlemelere ilişkin eleştirileri sunup çözüm yolları önermektir. Çalışmamızda, iftira suçunun oluştuğunu kabul edebilmek için gerekli kıstasları ve suçun sınırlarını çizerek hukuka uygun ve hukuka aykırı alanı belirlemeye çalıştık. Çalışma üç bölümden oluşmakta olup, ilk bölümde konu ile ilgili temel açıklamalar, ikinci bölümde iftira suçunun unsurları, üçüncü bölümde ise suça etki eden sebepler ile suçun özel görünüş biçimleri incelenmiştir. | tr_TR |
| dc.description.ozet | The subject of our study is ''Slander Crime'' in Turkish Criminal Law. As there are limited studies about the 5237 numbered TCL term, we aim to contribute to the criminal law science field by gathering theoretical discussions about slander crime, compiling the implementations of the High Court and adding our own point of view. Another purpose of our own is to present questionable rulings and critiques about some of the regulations and proposing solution methods. In our work we have studied the necessary criterions for accepting the slander crime has occurred and tried to determine the spaces that are compatible with the law and against it by drawing the lines of the crime itself. The study is consisted of three chapters, in the first chapter there are basic explanations about the subject, elements of slander crime are located in the second chapter and in our third chapter the reasons that affect the crime and private aspect forms have been examined. | tr_TR |
