| dc.description.abstract | Yükseköğretime ilişkin hizmetin, etkili ve verimli bir şekilde yürütülebilmesi için disiplin ve müeyyideler düzenine gerek bulunmaktadır.Bu düzenlemelerin; Anayasal hükümlere, üst hukuk normlarına, hukukun genel ilkelerine uygun ve yükseköğretim kurumlarının niteliğine paralel bir içeriğe sahip olmaları gerekmektedir.Yükseköğretim öğrencilerine yönelik disiplin kurallarının; yükseköğretim kavramının amaç ve niteliği ile bağdaşan, eğitim hizmetinin düzenli ve verimli bir şekilde sunulmasını sağlamaya yönelik, temel hak ve özgürlüklere saygılı düzenlemelerden oluşması gerektiğinden hareketle Yükseköğretim Kurumları Öğrenci Disiplin Yönetmeliğinin ve uygulamaların yargı kararlarından örnekler verilerek hukukun genel ilkeleri ve üst hukuk normları çerçevesinde değerlendirilmesine çalışılmaktadır. | tr_TR |
| dc.description.ozet | It is required to have a system of discipline and sanctions, for the execution of the services regarding the higher education in an effective and productive manner.Such regulations should have a content which is complying with the Constitutional provisions, upper norms of law, general principles of law and is parallel to the nature of higher education institutions.It is hereby aimed to evaluate the Regulation on Student Discipline in Higher Education Institutions and the practice within the context of the general principles of law and upper norms of law, by giving examples of the court decisions; based on the fact that the disciplinary rules for higher education students should consist of regulations complying with the purpose and nature of the `higher education? term, ensuring the education services to be provided in a regular and efficient manner, considerate to the fundamental rights and freedom. | tr_TR |
