Abstract

Environmental problems, cultural and natural heritage areas and the concept of protection have become the common ground of all countries at a time when country borders began to disappear with the effect of globalization. It is known that conservation practices directly affect the use of real estate while the extent of the restrictions on the use, utilization and tenure rights of privately owned real estate is well known. The concept of protection, which is based on the concepts of "public interest" and "community or general interests" in Turkey, restricts the right to property and property owneers protected by the Constitution and laws and hence causes conflicts between planning authorities, protection practices and private property in protected areas. In practice, the conflict between ownership and protection, and the inability to solve the problems with existing tools necessitate the development of alternative implementation tools for conservation policies. Within the scope of the study, public interest and private property conflicts in the field were examined in the light of judicial decisions by considering conservation practices, planning processes, protection approaches of authorized institutions and organizations and obligations imposed on private property within the boundaries of Ürgüp district and Göreme town within the boundaries of Cappadocia area of Nevşehir province. In the research, a survey was conducted with two different audiences namely the stakeholders and the headmen of village and neighbourhood. The results were evaluated through descriptive statistics and the demographic information of the stakeholders and their responses on the linkages between planning and ownership in conservation areas were evaluated together and examined by applying the "independent samples "t" and "one way ANOVA" tests results. In the conducted research, the proportion of stakeholders who declared that site certification and zoning rights transfer tools were used in the area was 92%, and it was determined that the means of implementing protection were not sufficiently known to the stakeholders. However, 24% of stakeholders stated that real estate development and management experts should play a role in conservation practices. Although the effects of the conservation practices observed within the borders of the Cappadocia area on ownership are in parallel with the conservation approaches adopted throughout the country, it should be emphasized that the institutional structure and protection approaches created by the area-specific legal regulations have been reshaped and a new corporately strengthened management approach has been formed in the areas of protection.
