dc.description.abstractBilindiği üzere Roma köleci bir toplumdu ve iş gücünün önemli bir kısmı köleler tarafından sağlanmaktaydı. Bu durumun Roma'da hizmet sözleşmesinin gelişimini olumsuz anlamda etkilediği düşünülebilir. Bununla birlikte, Roma'nın siyasal ve sosyo-ekonomik değişimleri incelendiğinde ekonomik anlamda güçlüklerle karşılaşan özgür Romalıların emeklerini bir şekilde değerlendirmek zorunda kaldıkları anlaşılmaktadır ve bu durum özgürler arası iş ilişkilerinin düzenlenmesini zorunlu kılmıştır. Bu kapsamda locatio conductio sözleşmesi ile özgür vatandaşlar emeklerini kiralamak durumunda kalmışlardır. Locare (bir şeyi bir yere koymak) ve conducere (bir şeyi götürmek, üstlenmek, yönetmek) fiillerinden türetilmiş olan locatio conductio kavramı, özünde bir kira ilişkisini ifade etmektedir ve Romalılar bu üst kavram çatısı altında günümüzdeki kira, eser ve hizmet sözleşmelerini beraber değerlendirmişlerdir. Bu kapsamda locatio conductio operarum olarak adlandırılan sözleşme, günümüzdeki hizmet sözleşmesine karşılık gelmektedir ve ilk bölümde bu sözleşmenin tanımı ve özellikleri, hizmet (opera) kavramı ve unsurları, sözleşmenin gelişimi ve konusu, tarafları, tarafların borçları ve sorumlulukları, sözleşmenin sona ermesi ve benzer sözleşmeler ile karşılaştırılması incelenmiştir. Modern hukuk ile Roma hukuku arasındaki benzerliklere ve farklılıklara ise dipnotlarda temas edilmiştir. Tezin ikinci bölümünde ise sözleşmenin tarafları arasında hiyerarşik bir ilişki yaratan bağımlılık ilişkisi, Roma'nın tarihsel gelişimi ile beraber ayrıca değerlendirilmiştir. Bu kapsamda Roma'nın köleci bir toplum olmasına rağmen ve toplumda ücret karşılığında çalışmanın hoş karşılanmamasına rağmen, özgür Romalı vatandaşları emeğini kiraya vermek zorunda bırakan ve iş ilişkilerine yön veren Roma'nın siyasal ve sosyo-ekonomik değişimleri irdelenmiştir. Tüm bu değişimlerin özgür iş gücü piyasasını nasıl oluşturduğu ve bunun işçinin işverenine olan bağımlılığını nasıl şekillendirdiği ve işvereni karşısında işçiyi adeta efendi himayesinde yaşamını sürdüren bir köleye nasıl yaklaştırdığı hususu değerlendirilmiştir. Bundan başka, özgür işçiler ile benzerlikleri dolayısıyla borç kölesi olarak değerlendirilebilecek olan nexus ile Roma toplumunda önemli bir yere sahip olan azatlı kölelerin durumu ayrıca değerlendirilmiştir. Roma'dan sonraki süreçte ise Roma hukuku etkisinde şekillenen hizmet sözleşmesi ve bu kapsamda bağımlılık ilişkisi irdelenmiştir. Son olarak, işçinin işveren karşısındaki ekonomik ve toplumsal alandaki fiili bağımlılığının hukuki boyutları üzerinde durulmuştur.tr_TR

dc.description.ozetAs its known ancient Rome was a slave society and the most of the workforce was satisfied by slaves. Under these circumstances, one could think that service contract had no important role in this society. However the decrease in the economic welfare has caused the free citizens to get involved in employment relationship with each other and this led a change in this view. In this regard, the need of free citizens to make living has forced them to lease out their services via locatio conductio. The concept of locatio conductio, derived from Latin verbs locare (to place something somewhere) and conducere (to take away or undertake something), fundamentally constitutes a lease relationship. This concept has been used as an umbrella term to evaluate together three different contracts; lease, work and service. In this context, locatio conductio operarum was defined as lease of services for a certain period of time. In the first part of this research, distinguishing characteristics of the contract was tried to be presented: The definition and characteristics of the contract, the concept of operae (labor) and its components, the development and subject of the contract, the contracting parties, obligations and responsibilities of the parties, the termination of the contract and finally distinctions and similarities between other agreements were examined. In this respect, similarities and differences between modern Turkish law and Roman law were also pointed out in the footnotes. In the second part of the research, legal subordination, which creates a hierarchical relationship between the parties of the contract, was evaluated in the light of Roman society's historical development. In this context, it was explored why Roman citizens are forced to hire their labor for a certain time for somebody for wages, in spite of the fact that ancient Rome was a slave society and it was not welcomed to work for wages in the society. It was also examined how these changes have shaped the free labor market and the dependence of the employee on the employer. Moreover, due to its similarities between the free workers, the situation of nexus, which can be regarded as a debtor slave, and the freedmen who had an important place in Roman society were also evaluated. In addition, Roman law influence on the service contract and legal subordination in this context were evaluated. Finally, the legal aspects of the subordination of the workers were emphasized.tr_TR
