dc.description.abstract | Şahsi teminat sözleşmelerinin en yaygın görünümlerinden olan müteselsil kefalet sözleşmesinde kefil, asıl borçlunun borcunun ifasını teminat altına almak amacıyla, haczedilebilir tüm malvarlığı ile sorumluluk altına girmektedir. Müteselsil kefilin, yüklendiği bu riskli durum karşısında kanunkoyucu tarafından Türk Borçlar Kanununun genel sistematiğinde kefili korumayı amaçlayan düzenlemelere geniş yer verilmiş olduğu görülmektedir. Müteselsil kefalet sözleşmesinin tarafları alacaklı ile kefil olsa da; borcun asıl borçlu tarafından ifa edilememesi durumunda müteselsil kefilin sorumluluğuna gidildiğinde, kefilin durumu asıl borçluya kıyasla ağırlaşmış olacaktır. Kanunkoyucu asıl borçlu ile ifada bulunan müteselsil kefil arasındaki menfaat dengesini, kefilin alacaklının haklarına ve alacak için gösterilen teminatlara halef olması suretiyle sağlama amacı gütmüştür. Çalışmamızda, müteselsil kefil ile asıl borçlu arasındaki ilişkide kefil ve asıl borçlunun hak ve yükümlülükleri açıklanarak güncel sorunlara içtihatlardan da örnekler verilerek değinilmeye çalışılmıştır. | tr_TR |

dc.description.ozet | In a joint guaranty, one of the most common types of personal guarantee agreements, the guarantor is responsible for all their attachable assets in order to guarantee the discharge of the primary obligator's debt. While the guarantor is undertaking a great risk, it is seen that the legislator has given a wide berth within the general systematics of the Turkish Code of Obligations related to regulations aimed at protecting the guarantor. As the main parties to the joint guaranty are the guarantor and the debtor, the guarantor's financial situation can be aggravated if the primary debtor cannot discharge the debt and the guarantor becomes liable. The legislator has aimed to safeguard the balance of interests between the principal debtor and the joint guarantor by ensuring that the guarantor is a successor to the rights of the creditor and the guarantees provided for the receivable. The aim of this study is to address the current issues in joint guaranties by examining the rights and obligations of the guarantor and the principal debtor in relation to their relationship within this type of agreement by providing examples from case law. | tr_TR |
