Policyholder's duty of disclosure in the insurance contract is a crucial issue both by its essences and consequences. Duty of disclosure is mainly arranged in Turkish Commercial Code (Nr: 6102), articles between 1435 and 1443. Despite extinct commercial code (Nr:6762), new code has more detailed articles, since duty of disclosure's importance, some of the spesific details will continue controversial. In this study, we will examine the reason of why duty of disclosure is arranged specifically in the code, who has duty of disclosure and to whom, the meaning and the context of the duty, the basis of duty of disclosure relating to law and finally the consequences of the breach of duty of disclosure.
