In the introduction, having analysed the social and cultural structure and basic institutions in Andalus up to the the end of Murabits, we deal with the concept of Hisba and its historical development there. In Chapter One, after analysing foundation of hisba organization, we treated muhtasib as a whole, ie, his appointment, dismissal, payment, deputies and position in the social structure of the time. In addition, other close institutions to hisba have been treated of In Chapter Two, the duties of muhtasib, his organizing and arranging markets and control of municipal sendees and others are tackled However far the history of Hisba in Andalus goes back to the beginnings of the islamic rule, it was named distinctively. Muhtasib in Andalus was called sahibu's-suk because he was supervising bazaars as distinctly from other Islamic parts. In this chapter we tried to show the close relationship among the institutions in Andalus especially those of justice, police, etc We showed here that the duties of muhtasib range from ensuring the consumer to return the defected goods to the buyer to detecting religious services. This range displays how wide and comprehensive were the duties carried out by muhtasib. Wliat follows from this fact is that muhtasibs chosen from the judges had an immense penetration arising from this range. Consequently it has been established that as a result of his performing various duties, it is unlikely to determine the clear-cut job of muhtasib.
