The subject of thesis is, ?The reflection of suretyship contract in Roman Law to present law?. It contains two parts excluding introduction and conclusion.Suretyship contract in Roman Law was analyzed in first part. Some informations were accorded about stipulatio before not explain suretyship. Because suretyship contracts was made by stipulatio which is accepted in the group of parol aggrements. And then suretyship contract was explained. There were three mains concepts in Roman Law that defined the suretyship contract which were sponsio, fidepromissio and fideiussio. In this part definition, features, subject, types differences from similar instruments, conditions of validity, the issue of capacity of women in suretyship and the reasons that conclude suretyship contract were examined.In second part suretyship contract in Turkish Law was examined. In this part definition, features, subject of suretship contract, conditions of validity, kinds of suretyship, responsibility of surety were examined. The Bill of Turkish Law of Obligations was examined and different parts were defined.During writing thesis basic sources of Latin Institutiones of Gaius and Iustinianus were used. Besides Turkish and foreign sources were examined too.In conclusion part similar and different parts of suretyship contract were defined in Roman and Turkish Law. The importance of Roman Law was mentioned.
