dc.description.abstractFikri ve Sınai Mülkiyet Hukuku alanında Marka hakkı, hak sahibine tescilli markanın kullanılması için inhisari (tekel) hakları vermektedir. Bu haklar mutlak nitelikte olup, bütün üçüncü şahıslara karşı ileri sürülebilmektedir. Bu marka hakkının önemli bir istisnası ise, içtihatlar ile ortaya çıkarılmış Tükenme (İlk Satış Doktrini) İlkesidir. Tükenme ilkesi ile marka sahibinin marka üzerindeki tekel hakkı sınırlandırılmıştır. Bu sınırlama ise markalı malın ilk satışı veya iktisadi amaçla ilk kez marka sahibinin zilyetliğinden çıkışı ile olmaktadır. Marka sahibinin rızası ve iktisadi amacı ile elinden çıkartmış olduğu malın üzerindeki marka hakkı bu ilke ile tükenmiş sayılacaktır. Marka sahibi elinden çıkartmış olduğu malın, pazarda tekrar satışına marka hakkına dayanarak engel olamayacaktır. Çalışmamız içerisinde tükenme ilkesinin de sınırları ve istisnaları detaylıca anlatılmıştır. Buna göre markalı malın marka sahibinden alındıktan sonra üzerinde kötüleştirme veya değiştirilme yapılması halinde tükenme ilkesinin uygulanmayacağı bir istisna olarak kabul edilmektedir. Ayrıca AB Hukuku'na göre marka sahibinin haklı bir nedeni karşısında yine marka hakkının tükenmeyeceği kabul edilmektedir. ABD Hukuku'nda ise, marka korumasında tükenme ilkesini engellemek adına farklı pazarlara farklı nitelik ve kalitede ürünler dağıtıp, bu ürünlerin farklı pazarda satılmasının markanın imajına zarar vereceğinden bahisle tükenme ilkesinin bu durumda uygulanmayacağı istisna olarak kabul edilmiştir. Trademark right in the field of intellectual and industrial property law, provides exclusive rights for rightholder in order to use of registered trademark. These rights are absolute rights and able to be propounded against whole third parties. A significant exception of trademark right is the principle of exhaustion (First Sale Doctrine) which derived from judicial decisions. Exclusive right of the rightholder on the trademark is restricted through the principle of exhaustion. This restriction occurs by way of disposal of the registered trademark from possession of rightholder with the intent of economical purposes or intent of first sale. The trademark right on the property which is disposed with the consent of rightholder and for economic purposes, is going to be deemed as exhausted due to the afore-mentioned principle. Rightholder is not going to be able to prevent the resale of the property in the market which is disposed, on the basis of trademark right. Limits and exceptions of principle of exhaustion are also considered detailedly in our study. Accordingly, It is agreed as an exception that in the condition of worsening or conversion of the registered property, principle of exhaustion is not going to be applied. As to regulations of USA law, it is agreed as an exception that principle of exhaustion is not applicable because of the reason that dispersion of goods witt different qualities in order to prevent the implementation of principle of exhaustion, would damage the image of trademark.tr_TR
