İslam Hukukunda tarıma elverişli arazilerin ihya edilmesi (Uganda Hukuku ile mukayeseli)
Özet
Tez; giriş, üç bölüm, sonuç ve bibliyografyadan oluşacak şekilde hazırlanmıştır. Girişte, tezin içerik ve yöntemi hakkında bilgiler verilmiştir. Tezin birinci bölümünün kendi içerisinde dörde ayrılması uygun görülmüştür. İlk kısımda tarıma elverişli olmayan arazinin ıhyâ edilmesi ve İhyâ ile doğrudan ilgili kavramlar, ikinci kısımda mevât arazilerinin İhyâ edilmesinin hukukî dayanakları, üçüncü kısımda ihya edilmeden ve ihya edildikten sonraki mülkiyeti, mevât arazinin unsurları ve ihya yöntemleri, dördüncü kısımda ise mevât arazinin ihya edilmesinde aranan şartlar ve önemi ele alınmıştır. Tezin ikinci bölümünde Mevât arazinin İhyâ edilmesinin hukuki süreci ve İhyâ ediliş şekilleri incelenmiştir. İlk kısımda mevât arazinin ihya edilmesinin hukuki süreci ele alınmış. İkinci kısımda ise mevât arazinin ihya ediliş şekillerine yer verilmiştir. Tezin üçüncü bölümünde ise, Arazinin İhyâ edilmesi meselesinde İslam hukuku ile Uganda hukuku arasında bir karşılaştırma yapılarak aradaki benzerlik ve farklılıklar ortaya konulmaya çalışılmıştır. İlk kısımda Uganda'daki mevât arazilerinin bilgisi ve bugünkü İhyâ etme sebepleri, ikinci kısımda uganda'da mevât arazisinin ihya edilmesine ilişkin hukuki düzenlemeler ve islam hukuku ile kıyaslanması. Tez üç ana bölümden sonra gelen sonuç bölümüyle sona ermektedir. Sonuç bölümünde, yapılan çalışma sonucunda konuyla ilgili elde edilen kanaatler ve öneriler yer almaktadır. The thesis consists of introduction, three chapters, conclusion and bibliography. The introduction comprises of the information about the content and methodology of the thesis. The first chapter of the thesis is comprised of four sections. The first section discusses the definition and revivification of the deadland(wasteland) [land(arazi), revivification(İhyâ), dead/waste(mevat)] both the literature and conventional Islamic meaning of these terms. The second section deems the evidence both in reporting and logic, which illustrates the legitimacy of reviving the deadland(wasteland). The third section views the elements of the deadland(wasteland) and the situations of ownership before and after the reviving, whereas the fourth section is about the conditions of the land to be revived, the conditions of the reviver and the significancies of reviving land. The second chapter of the thesis is about the legal issues, stages and modes of land revivification. This chapter has two sections; the first section deemed the legal issues and stages of the restoration of the land, whereas the second section, discusses modes and varieties of the land revivification. The third chapter of the thesis focuses about the comparison between Islamic laws and Uganda laws in regard of land reviving and development. The first section reveals information about Uganda's land, usage and the reasons that have boomed its revivification and development. The second section discusses the comparisons between Islamic laws and Uganda laws in regard of land reviving and development. The thesis ends with the conclusion of the three main chapters.
