dc.description.abstractTürk hukukunda geçici koruma statüsü sahibi yabancıların çalışma haklarını incelemek amacıyla bu tez çalışmasında öncelikle uluslararası alanda geçici koruma kavramından ne anlaşıldığı açıklığa kavuşturulmaya çalışılmıştır. Çalışmamızın ikinci bölümünde Türk yabancılar hukukunda 1994 Yönetmeliğinden günümüze kadar yapılan düzenlemeler ile geçici koruma statüsü ve bu statüye bağlanan haklar ve bu hakların niteliği incelenmiştir. YUKK ve GKY ile birlikte Türk yabancılar hukukunda kendisine sui generis bir yer edinen geçici koruma statüsü, çalışma piyasasına erişimi kolaylaştırmıştır. Bu durum, yasa dışı çalışan geçici koruma altındaki yabancının, bu çalışmasının gerçekten yasa dışı olup olmadığı ve dolayısıyla da bu çalışmaya herhangi bir sonuç bağlanıp bağlanamayacağının tespiti bakımından da önem arz eder. Çalışmamızın son bölümünde Türk yabancılar hukukunda geçici koruma altındaki yabancılara sağlanan çalışma hakkı ulusal ve uluslararası mevzuat göz önünde bulundurularak incelenmiştir. Bu bağlamda Cenevre Sözleşmesi'nde mülteci statüsü tanınmamış sığınmacıların iş piyasasına erişimi konusunda öngörülen liberal yaklaşımın geçici korunanlar bakımından da uygulanıp uygulanamayacağı sorusuna diğer uluslararası sözleşmeler de göz önünde bulundurularak cevap aranmıştır. Çalışmamızın en son kısmında ise geçici korunanların çalışma izni almaksızın Türkiye'de çalışmaları durumunda bu sözleşmeye hukuki sonuç bağlanıp bağlanamayacağı doğrudan uygulanan kurallar ve kamu düzeni düzleminde doktrindeki görüşlere yer verilerek incelenmiş ve bu konudaki değerlendirmelerimize yer verilmiştir. In this thesis in order to examine the temporary protection status under Turkish law, we first clarify the definition of temporary protection under international law. In the second chapter of our study, we analysed temporary protection status under Turkish foreigners law by evaluating all the regulations enacted since 1994 Regulation and the rights attached to this status together with the characteristic of these rights. Temporary protection status, which has established itself a sui generis place in Turkish foreigners law, especially with the Law 6458 on Foreigners and International Protection (YUKK) and Regulation on Temporary Protection (GKY), has facilitated access to the labour market. This is also important to determine whether there has been an illegal employment and if so, what are the legal consequences of such illegal employment, in a possible illegal employment of foreigners under temporary protection status. In the last chapter, we examined the right to work under temporary protection status in Turkish foreigners law tried to answer the question of whether the liberal approach envisaged in the 1951 Geneva Convention for refugees whose status has not yet been recognized on the access of labour market, can also be applied to the persons under temporary protected status by considering other international conventions. In the last section of our study, we analysed whether a legal effect can be given to the contract regarding illegal employment within the context of both mandatory rules and public order and accommodated views in the doctrine and gave our assessment on this subject.tr_TR
