dc.description.abstract6098 sayılı Türk Borçlar Kanunu'nun yürürlüğe girmesiyle birlikte "kısmi ifa imkânsızlığı" kavramı kanun metninde ilk defa kullanılmıştır. Kanun gerekçesinde zorunlu bir düzenleme olarak kabul edilen TBK m. 137 ile borçlunun sorumlu olmadığı kısmi ifa imkânsızlığı düzenlenmiş olmasına rağmen, borçlunun sorumlu olduğu kısmi ifa imkânsızlığı düzenlenmemiştir. Eksik bir düzenleme olan ve TBK m. 137'de düzenlenen kısmi ifa imkânsızlığının incelendiği çalışmamızın birinci bölümünde imkânsızlık kavramı, imkânsızlığın dayandığı sebepler ve imkânsızlık türleri incelenmek suretiyle türler arasındaki farklar ortaya koyulmuştur. İkinci bölümde çalışmamızın konusu olan kısmi ifa imkânsızlığı TBK m. 137'deki düzenlemenin aksine borçlunun sorumlu olduğu kısmi ifa imkânsızlığı ve borçlunun sorumlu olmadığı kısmi ifa imkânsızlığı ayrımına tabi tutularak incelenmiştir. Tek tarafa borç yükleyen sözleşmeler ve karşılıklı borç yükleyen sözleşmelerde meydana gelen kısmi ifa imkânsızlığı irdelendikten sonra kısmi ifa imkânsızlığını meydana getiren unsurlar ve bu kapsamda kısmi ifa, bölünebilir-bölünemez edim kavramları ele alınmıştır. İkinci bölüm, kısmi ifa imkânsızlığının benzer kavramlar ile karşılaştırılması suretiyle sonlandırılmıştır. Üçüncü bölümde ise, borçlunun sorumlu olduğu ifa imkânsızlığı ile borçlunun sorumlu olmadığı kısmi ifa imkânsızlığına bağlanan sonuçlar detaylı olarak ele alınmıştır. Bu kapsamda kısmi ifa imkânsızlığının borç ilişkisine etkisi, bildirim ve zararın artmaması için gerekli önlemlerin alınması yükümlülüğü, kaim değer talebi, bu talebin unsurları ve sonuçları ile tazminat talebinin sınırları çizilmiştir. İki tarafa borç yükleyen sözleşmelerde meydana gelen kısmi ifa imkânsızlığının karşı edimin akıbetini nasıl etkilediği sorusunun cevaplandırılması suretiyle üçüncü bölüm de sonlandırılmıştır. The term of "the impossibility of partial performance" has been used for the first time through the effectiveness of the Turkish Code of Obligations No 6098. Although the impossibility of partial performance, for which the debtor is not responsible, is accepted as a mandatory regulation according to the Turkish Code of Obligations article 137's preamble, the impossibility of partial performance, for which the debtor is responsible, has not been regulated. In the first part of our stud that examines the impossibility of partial performance under the article 137 of the Turkish Code of Obligations which is an incomplete regulation, the term of impossibility, the causes of impossibility and the types of impossibility and the distinctions between these terms are analysed. In the second part, unlike the regulation under the article 137 of the Turkish Code of Obligations, this part focuses on the distinction between the impossibility sedof partial performance, for which the debtor is responsible and the impossibility of partial performance, for which the debtor is not responsible. After analysing the impossibility of partial performance, which is occurred in unilateral contracts and bilateral contracts, the circumstances that result because of the impossibility of partial performance, the terms of partial performance, divisible-indivisible obligations are examined. The second part also compares the impossibility of partial performance with similar terms. In the third part, the results related to the impossibility of partial performance, for which the debtor is responsible and impossibility of partial performance, for which the debtor is not responsible are analysed in detail. In this context, the effects of impossibility of partial performance on the debtor-creditor relationship, the obligation to take the necessary precautions to avoid further notice and damage, the replacement value, the limits of the compensation claim have been identified. Finally, the third part also engages with the question of how the impossibility of partial performance, which is occurred in the mutual contracts, affects the existence of the contrary obligation.tr_TR
