dc.description.abstractAnayasal-demokratik rejimlerinin temel yapı taşlarından biri olan güçler ayrılığı, insanların hak ve özgürlüklerini korumak ve yönetenlerin despotizme yönelmelerini önlemek için devletin iktidarını tek kişi veya organa değil, yatay biçimde birbirini denetleyen ve dengeleyen üç organa (yasama, yürütme ve yargı) verilmesini esas alan bir mekanizma olarak farklı hükümet sistemleri (Başkanlık, Yarı-Başkanlık ve Parlamenter) biçiminde uygulanmaktadır. Çalışmada bu mekanizmaya göre, Türkiye'de 16 Nisan 2017 tarihinde yapılan son Anayasa değişikliğiyle getirilen hükümet sistemi ve Afganistan'ın 2004 tarihli son Anayasası çerçevesinde uygulamaya konulan hükümet sistemi, devletin organlarının karşılıklı ilişkileri ve birbirine karşı sahip olduğu denge ve denetim mekanizmaları karşılaştırmalı biçimde ele alınmıştır. Çalışmanın sonucunda, her iki ülkenin hükümet sisteminin hem parlamenter hem de başkanlık hükümet sistemlerinin özelliklerinden esinlendiği ve bu durumdan ötürü sistemin tanımlanması konusunda tartışmalara neden olduğu tespit edilmiştir. Bu bağlamda Türkiye'nin hükümet sistemi daha sert güçler ayrılığına dayandığı, anayasada "Başkan" kavramının yerine "Cumhurbaşkanı" kavramı kullanıldığı ve siyasi organların birbirinin hukuki varlığına son verebilme yetkisine sahip olduğu için hükümet sistemine "Cumhurbaşkanlığı Hükümet Sistemi" ve "Türk Tipi Başkanlık Hükümet Sistemi" denilmektedir. Türkiye'den farklı olarak Afganistan hükümet sistemiyse daha yumuşak güçler ayrılığına dayandığı için hükümet sistemi teoride "Yarı-Başkanlık Hükümet Sistemi" pratikte ise "Başkanlık Hükümet Sistemi-Afganistan Tipi Başkanlık Sistemi" olarak adlandırılmaktadır. Her iki ülkede yasamaya karşı güçlü ve monist yürütme oluşturmanın temel gerekçeleri istikrarlı ve etkin hükümet oluşturma düşüncesi olmuştur. Türkiye'nin hükümet sistemi yeni değişikliğe uğradığı için beklenen sonuçları karşılayıp karşılayamayacağı konusunda değerlendirmelerde bulunmak henüz erkendir. Ancak Afganistan'da uygulanmaya konulan monist yürütme, bırakın istikrarın sağlanmasını, toplumun daha da kutuplaşma/ayrışmasına, demokrasiyi kesintiye uğratmasına, ulus/modern devletin kurulmamasına, siyasi partilerin güçsüzleşmesine, iktidarın tekelleşmesine ve meclisin işlevsizleşmesine neden olduğu bu çalışmada tespit edilmiştir. Siyasi sistem bağlamında Türkiye'nin kazandığı tecrübe ve birikimden faydalanarak Afganistan hükümet sisteminin revize edilmesi konusunda bazı öneriler (geçici olarak Yarı-başkanlık sisteminin kurulması, nüfus sayımının yapılmasıyla meclis seçim sisteminin değiştirilmesi, Cumhurbaşkanı KHK çıkarma yetkisinin sınırlandırılması ve anayasa uygunluk denetimiyle bireysel başvuruları karara bağlayan bir Anayasa Mahkemesinin kurulması) sunulmuştur. The separation of powers, which is one of the fundamental building blocks of the constitutional-democratic regimes, is applied in the form of different government systems (Presidential, Semi-Presidential and Parliamentary) as a mechanism based on granting the power of the state to three bodies (legislative, executive and judiciary) that control and balance each other in a horizontal manner, not to control the power of the state to one person or body in order to prevent the rulers to turn to despotism. According to this mechanism in the study, the government system introduced by the last amendment (April 16, 2017) of the Constitution in Turkey and the government system introduced in the framework of Afghanistan's last (2004) Constitution, the bilateral relations of the organs of the state and the mechanisms of balance and control that are held against each other are discussed in comparative manner. As a result of the study, it was determined that the government system of both the countries were inspired by the features of both parliamentary and presidential government systems and these features cause controversy over the definition of the system. In this context, as for Turkish system of government is based on the more rigid separation of powers and for using the concept of the 'President of the Republic' instead of the 'President' and for political organs have the capacity to put an end to each other's legal existence the government system is called the 'Presidential Government System' and the 'Turkish Type Presidential Government System'. Unlike Turkey, because of the government system in Afghanistan is based on a softer separation of Powers it is called the 'Semi-Presidential Government System' in theory and the 'Presidential Government System' in practice. The main reasons for creating a strong and monistic executive against legislation in both countries were the idea of creating a stable and effective government. As for the government system in Turkey has been transformed to a new system it is still advance to assess whether it can meet the expected results. However the monist administration in Afghanistan, the study found, led to the deestabilization of steadyness, further polarization of the society, disruption of democracy, failure of the nation / modern state, weakening of the political parties, monopolization of the power and the disfunction of the assembly. Benefiting from Turkey's experience and knowledge gained in the area of the political system some proposals (temporarily establishing a semi-presidential system, changing the parliamentary election system through the census, restriction of the authority of the President to issue Decree of Public Law and the establishment of a Constitutional Court that decides individual applications by constitutional compliance control) have been made regarding the revision of the system of government in Afghanistan.tr_TR
