| dc.description.abstract | Çalışmanın konusunu eser sözleşmesinin ifasında kabul oluşturmaktadır. Eser sözleşmesinde ifa, iş görme sonucunun eserin tamamlanmasıyla elde edildiği durumlar hariç, eserin teslimi ile gerçekleşir. Eserin teslimi, eser sözleşmesinde sözleşmenin ifası anlamına gelir ve eserin yüklenici tarafından teslim edilmesini ve iş sahibi tarafından teslim alınmasını ihtiva eder. Kabul ise, iş sahibinin teslim edilen eserin sözleşmeye uygun ve ayıpsız sayıldığına ilişkin irade beyanıdır. Eserin kabulü ile birlikte objektif bakımdan kötü ifa gereği gibi bir ifa haline gelir. Bu nedenle kabul, eser sözleşmesinin ifasında iyileştirici bir etkiyi haizdir. Kural olarak bir irade beyanı ile gerçekleşen kabul, belirli durumlarda iş sahibinin irade beyanı olmaksızın ve iş sahibinin fiillerinin yüklenici tarafından nasıl anlaşıldığı dikkate alınmaksızın kanundan dolayı gerçekleşir. Türk Borçlar Kanunu'na göre kabulün hukuki sonucu, yüklenicinin ayıp sebebiyle sorumluluktan kurtulmasıdır. Eserin iş sahibi tarafından açıkça veya örtülü olarak kabul edilmesi ile birlikte yüklenici ayıp sebebiyle sorumluluktan kurtulur; meğerki teslim ve usulüne uygun gözden geçirme sırasında fark edilemeyen veya yüklenici tarafından iş sahibinden kasten gizlenen bir ayıp bulunsun. Kabulün iş sahibi bakımından doğurduğu hukuki sonuç ise, ayıptan doğan hakların kaybedilmesidir. Eserin kabulü, ayıbı takip eden zararların tazmini de dâhil olmak üzere ayıptan doğan bütün hakların kaybedilmesi sonucunu doğurur. Meğerki iş sahibi kabulü çekince ile beyan etmiş olsun. Bununla birlikte iş sahibinin ayıba ilişkin olmayan diğer hakları eserin kabulüne rağmen varlığını korur. The subject of the study is approval in the performance of the contract for work and services. The performance in the contract for work and services is performed with the delivery of the work, except in cases where the result of the work is obtained upon the completion of the work. The delivery of the work means the performance of the contract and it includes the delivery of the work by the contractor and the acceptance of the work by the customer. Approval is a declaration of the will of the customer about the delivered work is deemed to be in conform with the contract and free from defects. With the approval of the work, objectively bad performance becomes a performance as required. Approval, therefore, has a curative effect on the performance of the contract for work and services. As a rule, approval by a declaration of will takes place in certain cases due to the law, without the declaration of will of the customer and regardless of how the will of the customer is understood by the contractor. According to the Turkish Code of Obligations, the legal consequence of the approval means that the contractor is released from the defect liability. When the work is approved expressly or tacitly by the customer, the contractor is released from liability for defect except defects which could not have been discovered on acceptance and duly inspection or were deliberately concealed by the contractor. The legal consequence of the approval for the customer is the forfeiture of the warranty rights. Approval of the work results in the forfeiture of all warranty rights, including compensation for consequential damages except the customer has declared the approval with reservation. Additionally, other rights of the customer not related to the defect in the work remain despite the approval of the work.
