Özet
Afrika'da self-determinasyon politikaları incelendiğinde çeşitli alanlarda farklılıklar olduğu görülmektedir. Kıtadaki self-determinasyon politikaları ve uygulamaları birbirinden farklıdır. Tezde incelemek için seçilen her örnek de self-determinasyon politikalarına yönelik farklı bir noktayı, özelliği ortaya koymaktadır. Taleplerin gerekçeleri, yaşanan süreçler birbirinden farklılık göstermektedir. Ayrıca devletler ve self-determinasyon talebinde bulunan hareketler arasında hakka yönelik farklı algılama bulunmaktadır. Öte yandan Afrika'da self-determinasyona dair bazı örnekler uluslararası hukukta genelgeçer kabul gören uygulama ve anlayıştan da farklılık teşkil etmektedir. Bu farklılıklara rağmen kıtada self-determinasyona dair ortak bir tutum ve algılayış olduğu görülmektedir. Erite'nin ve Güney Sudan'ın ayrılma yönünde çalıştırdıkları self-determinasyonları emsal olarak değil; istisna olarak değerlendirilmektedir. Bu ortak tutum Afrika'da self-determinasyona dair örf ve adet hukukunun olduğunu göstermektedir. Sömürge yönetiminin varlığı ve uti possidetis gibi ayırt edici özellikleri de bulunmaktadır. Günümüzde kıtada self-determinasyon talep eden hareketler bulunmaktadır. Afrika'nın self-determinasyona yönelik genel tutumundan ve çerçevesinden farklılık teşkil etmektedir. Farklı hedefler ve bunlara getirilen cevaplar gündeme self-determinasyonun değişmesine, çeşitli siyasi unsurları kapsamasına dair talepleri de getirmektedir. Bu yönde devletler, iç self-determinasyon seçenekleri ile cevap vermeyi tercih etmektedir. Teamül değişikliği için yeterli veri, irade örneği kıtada mevcut dönemde bulunmamaktadır.AbstractAnalysis of policies of self-determination in Africa reveals that there have been differences in various areas like its application and perception. Politics and practices of self-determination of Africa have differed from each other. Henceforth, each selected example in thesis reveals a different point, peculiarity on self-determination. Grounds for demanding self-determination, respective processes differ from each other. Besides, there exist some different point of view on self-determination between the states and the movements asking for that right. On the other hand, several African self-determination instances differ from self-determination which has been widely accepted and applied in the international law. In spite of these differences, common perception and approach towards self-determination has already been existed in the continent. Eritrean and South Sudanese self-determinations resulted in secession are not accepted as precedents, rather they are recognized as exemptions. Such common position and approach indicates existence of customary law of self-determination in Africa. It contains distinguishing components like existence of colonial governance and uti possidetis. In today's conjuncture, there have been movements that demand self-determination. Such demand differs from Africa's general approach and framework on self-determination. Various goals and answers given to them bring demands on changing self-determination, on broadening its content through bringing several political components. States prefer to give answers through internal options of self-determination. There has been no enough data, examples on consent in Africa to be used as evidents for changes in self-determination in today's conjuncture.
