Dünya Fikri Mülkiyet Örgütü (WIPO) bünyesinde tahkim

Abstract

Birleşmiş Milletler'in fikrî ve sınaî haklar konusunda uzman kuruluşu olan Dünya Fikrî Mülkiyet Örgütü (WIPO) bünyesinde yürütülen tahkim, uluslararası ticaretin yoğunlaşması nedeniyle her geçen gün önem kazanmaktadır. WIPO bünyesinde tahkim, uluslararası unsurlu ticarî ilişkilerden doğan uyuşmazlıklara kurumsal düzeyde, kısa zamanda, tarafsız ve bağımsız hakemler yönetiminde, özel ispat araçlarıyla ve gizlilik çerçevesinde çözüm getirmektedir. Bilimsel çalışmamızda, WIPO'nun teşkilatı, sunduğu hizmetler ve Türkiye ile ilişkisi hakkında genel bilgiler verdikten sonra, WIPO Tahkim Kuralları'na göre yürütülen tahkimin özellikleri ve işleyişinin yanı sıra, tahkim yargılaması sırasında ortaya çıkan sorunlarla bunlara getirilen çözümleri ele aldık. Ayrıca, WIPO bünyesinde gerçekleştirilen tahkim sonucunda verilen hakem kararlarının iptal edilebilirliğiyle tanınması ve tenfizine ilişkin şartlara değindik. Abstract The importance of arbitration within World Intellectual Property Rights Organization (WIPO) which is an agency specialized on intellectual property rights of United Nations rises every day as a result of intensive international trade activities. WIPO Arbitration significantly provides solutions to the disputes arising from trade relations, but especially intellectual property rights, institutionally, quickly, under the management of impartial and independent arbitrators, with special facilities for evidence and within the frame of confidentiality. In this dissertation, after explaining WIPO?s organization, its services and its relationship with Turkey, we focused on the characteristics and proceedings of the arbitration under WIPO Arbitration Rules, the questions and their solutions related to arbitration processes. Moreover, we set forth the conditions of the annulment, recognition and execution of the final awards granted as a result of WIPO Arbitration.
