Özet
Tüketici hukukunun uygulama alanı oldukça geniştir. Tüketici hukukunda,tüketicinin sözleşmenin zayıf tarafı olarak görülmesi nedeniyle özel hukuka ait temelkurumlara farklı düzenlemeler getirilmiştir. Bu çalışmada tüketici hukuku teminatkurumu bakımından incelenmiştir.Bir sözleşmenin tüketici sözleşmesi olabilmesi için, taraflarının tüketici vegirişimci olması, tarafları arasında güç dengesizliğinin olması, mal ve hizmet arzınayönelik olması ve sözleşmenin karşılıklı edimler içermesi gerekir. Bununla birliktetüketici sözleşmesi olmak bakımından sözleşmenin türü veya tipi önem arz etmez.Bu çalışmada tüketici sözleşmelerinden doğan borcun ifa edilmemesirizikosunu teminat altına alan dar ve teknik anlamda teminat sözleşmeleriincelenmiştir.İpotek tesis etmenin zaman alıcı ve masraflı olması, birçok tüketicinin teminatgösterecek taşınmazının olmaması gibi nedenlerden dolayı ipotek, tüketicisözleşmesinin teminatı olarak pek kullanışlı değildir. İpotekli borç senedi ve iratsenedinin Türk Hukuku bakımından uygulaması pek yaygın değildir. Teslime bağlıtaşınır rehni ve hapis hakkı da taşınırın dolaysız zilyetliğinin devrini gerektirdiği içintüketici sözleşmelerinin teminatı olarak pek fazla tercih edilmez. Bir sicile tescilizorunlu olan taşınırların rehni ise taşınır teslim edilmeden, sicile tescil ile kurulduğuiçin uygulamada en çok karşılaşılan taşınır rehinlerinden biridir. Alacak ve diğerhaklar üzerinde rehin veya hapis hakkı tesisi de tüketici sözleşmelerinin teminatıolarak sıkça başvurulan teminatlardandır. Bununla birlikte tüketici sözleşmesininteminatı olarak kıymetli evraka başvurulduğunda, sadece nama yazılı ve her bir taksit251ödemesi için ayrı ayrı olacak şekilde kıymetli evrak düzenlenebilir (TKHK m.4/5).Kanunda düzenlenen teminat türlerinin ekonomik hayatın ihtiyaçlarınıkarşılayamaması nedeniyle uygulamada yaratılan teminatlardan olan teminat amaçlıinançlı işlemlere de başvurulmaktadır.Konut finansman sözleşmesinde tüketicilere sağlanan bu kredi hem yüksek birmeblağ olmakta hem de kredinin geri dönüşü oldukça uzun zamana yayılmaktadır. Bunedenle konut finansman sözleşmesinde teminat ayrı bir öneme sahiptir. Uygulamadaneredeyse tüm konut finansman sözleşmesi kapsamındaki konut kredisisözleşmelerinde tüketici, satın aldığı konut üzerinde kredinin teminatı olarak, kredikuruluşu lehine ipotek tesis etmektedir. Konut finansman sözleşmesi kapsamındakifinansal kiralama sözleşmesinde konutun mülkiyeti alacaklı olan konut finansmankuruluşunda olduğu için konut üzerinde ipotek tesisi mümkün değildir. Ancak buradada konutun mülkiyetinin finansman kuruluşunda kalması teminat amacına hizmetetmektedir.Tüketicinin Korunması Hakkında Kanunun 4. maddesinin 6. fıkrasındatüketicinin edimlerine karşılık verilen şahsi teminatın adi kefalet, tüketicininalacaklarına karşılık verilen şahsi teminatın da müteselsil kefalet sayılacağı hükmebağlanmıştır. Buna göre tüketicinin borçlarına karşı verilen şahsi teminatlara adikefalet hükümleri uygulanacaktır. Tüketicinin alacaklarına karşılık verilen şahsiteminatlara ise müteselsil kefalet hükümleri uygulanacaktır.AbstractThe application area of the consumer law is considerably broad. As theconsumer is regarded as the weak party to the contract in consumer law, differentregulations were brought to the basic institutions of the private law. In this study,consumer law was examined in terms of guaranty institution.In order for a contract to be a consumer contract, the parties thereto must bethe consumer and the entrepreneur, there must be an imbalance of power between theparties, it must be for the supply of products and services and the contract must includemutual executions. However, the kind and the type of the contract are not importantfor a contract to be a consumer contract.In this study, guaranty contracts, which secure the risk of not fulfilling theliability arising from the consumer contracts, are examined in narrow and technicalaspects.Mortgage is not very useful as the guaranty of the consumer contract as theestablishment of a lien is time consuming and expensive and as many consumers donot have any real estate to use as a guaranty. Application of mortgage bonds andannuity bonds is not very common in Turkish Law. Lien of movables subject todelivery and right of retention are not preferred very much as the guaranty of theconsumer contracts as it requires the transfer of the direct ownership of the movables.Lien of the movables, which have to be registered to a registry, is one of the liens ofmovables observed most commonly in the practice as it is established via registrationto the registry before the delivery of the movables. Lien on receivables and other rightsor establishment of right of retention is also among the guaranties applied frequently253as the guaranty of the consumer contracts. However, where valuable papers are usedas a guaranty of consumer contracts, valuable papers may be drafted in such a mannerthat they will only be in the name of the holder and individual papers are drafted foreach installment payment (Law on the Protection of the Consumer, article 4/5). Oneof the guaranties created in the practice, fiduciary transactions for guaranty purposesare also applied, as the types of guaranties regulated in the law do not satisfy the needsof the economic life.This credit provided to the consumers in the housing financing contracts is botha large amount and the re-payment of the credit takes a long time. For that reason,guaranty has a special importance in the housing financing contracts. In practice,nearly in all housing credit contracts within the scope of the housing financingcontracts, the consumer establishes a lien on the house bought by him as the guarantyof the credit in favor of the credit institution. In the financial leasing contract withinthe scope of the housing financing contracts, establishment of a lien on the house isnot possible, as the house is owned by the creditor housing finance institution.However, here, the retention of the ownership of the house by the finance institutionserves the purpose of guaranty.It was ruled in the paragraph 6 of the article 6 of the Law on Protection of theConsumer that the personal guaranty provided in return for the acts of the consumershall be deemed ordinary guaranty and the personal guaranty provided in return for thereceivables of the consumer shall be deemed joint guaranty. Accordingly, provisionsof ordinary guaranty will be applied to the personal guaranty provided against theliabilities of the consumer. In addition, provisions of joint guaranty will be applied tothe personal guaranty provided against the receivables of the consumer.
