| dc.description.abstract | Bentham’ın ceza teorisi, faydacı ahlak kuramı temelinde gelişmiş ve yaşadığı dönemin reformlarının ilham kaynağı olmuştur. Bentham, fayda ilkesi doğrultusunda toplumun mutluluğunu arttıracak yasaların çıkarılmasını talep etmiş, toplumun mutluluğunu azaltan uygulamaların son bulması çağrısında bulunmuştur. Toplumun mutluluğuna katkıda bulunmayan hukuk düzenlemeleri gibi, toplumun zarar görmesini, mutsuzluğunu önlemeyen ceza düzenlemelerini ve uygulamalarını da eleştirerek ilga edilmeleri önerisinde bulunmuştur. Cezanın temel işlevi olan önleyiciliği yerine getirmeyen ve caydırıcılığın ötesinde şiddet içeren cezaların kaldırılmasını savunmakla yetinmemiş, faydacıceza anlayışına dayanarak geliştirdiği Panoptikon projesiyle zamanının cezaevi zihniyeti ve koşullarında da değişime ihtiyaç olduğunu savunmuştur.AbstractBentham’s penal theory which was based on his utilitarian ethics inspired the reformations of his time.Conform to principle of utility, he appealed to bring in regulations which augment the happiness of the society and to annul the laws which diminish the happiness of the society. Likewise he suggested to abrogate the penal codes and practices that were not able to prevent mischief of the society. He did not just defend to abrogate the punishments which were not able to prevent crimes and contained harshness beyond the deterrence, but also claimed with his Panopticon Project which based on his utilitarian punishment thought, the mentality and the conditions of the penitentiary system of his time needed to be changed. | |
