Özet
Modern devletin yönetim sisteminde üç hukuki güç vardır. Bunlardanyasama ve yürütme, siyasal niteliktedir. Üçüncüsü olan yargı ise, bir yönüyle bu ikisiyasal gücü birey ve toplum yararına frenlemekle görevlidir. Yargının diğer işleviise toplumdaki uyuşmazlıkların, bireyler birbirlerine düşman olmadan, çözülmesinisağlamaktır. Bir taraftan toplumu ve bireyi devletin etkili iki gücüne karşı korumakzorunda olan diğer taraftan da bireylerin huzur içinde bir arada yaşamasını sağlamakzorunda olan yargı, bu görevlerini sağlıklı yerine getirebilmek için bağımsızlık vetarafsızlık niteliğini kaybetmemelidir.Bağımsızlığın ve tarafsızlığın korunması için adalet sistemi içinde bazıtedbirler almak gerektiği gibi; hakimlerde ve savcılarda yaptıkları işte, bağımsız vetarafsız olmak zorunda oldukları inancı yerleştirilmelidir. Hakimlerin ve savcılarınetki altına alınması ile kısa vadede bazı menfaatler elde etmeyi umanlar, uzun vadedeçürümüş bir sistem oluşturacaklarını bilmelidirler.Nitekim Türkiye tarihi, olağanüstü mahkemelerin çok sık tecrübe edildiği vesiyasal güçlerin hizmetindeki yargının, bu gücün karşısındaki kesimleri öğütmearacına dönüştüğü örneklerle doludur. Kazanan, kısa vadede yargıyı kontrol eden güçolsa da; uzun vadede toplumsal gelişmenin yavaşladığı, hatta yargıyı araçlaştırangücün toplumda kınandığı bir gerçektir.Türkiye tarihinde ne geçmişte ne de bugün yargının bağımsız ve tarafsızolduğu söylenemez. 2010 sonrası atılan bazı adımlar yargı bağımsızlığı adına umutverici olsa da ne yazık ki yetersizdir. Yeni anayasa Türkiye için büyük bir fırsatolabilir. Bu fırsat iyi değerlendirilmeli ve yargı bağımsızlığını ve tarafsızlığınısağlayacak özenli düzenlemeler yapılmalıdır.Abstract In modern political systems so called modern states, there are threefundamental powers. Two of them; legislation and execution have politic character,while the third one; judiciary, the judicial power, at one point is responsible to curbthe other two political powers for the benefit of both individual and society. Otherfunction of judicial power is to solve conflicts in society, preventing the possibilityof anarchy. Judicial power which in one hand have to protect society and personfrom strong powers of legislation and executive, on the other hand have to makepeople live together in peace, should not lose its independence and impartiality inorder to perform its functions well.In addition to taking precautionary measures to maintain judicialindependence and impartiality, it is needed that judges and prosecutors have tointernalize the perception of being independent and impartial while using judicialpower. Ones expecting short term benefits by repressing judges and prosecutorsshould know that they will lead to corruption in system in long term.In fact, Turkey’s history is full of examples where extraordinary courts arefrequently taken place and at the service of politic powers, judicial power hadbecome an instrument, grinding the opposite parties against it. Although the winneris the force that controls judicial power in short term, it is, in fact, in long term;social development is slowed down and the force which controls the judicial power iscondemned by the society. For Turkey, it is hard to say that the judicial power hasbeen independent and impartial.Even though some hope giving steps for judicial independence had beentaken after year 2010, yet it is not enough. New constitution may be considered as acrucial opportunity for Turkey. Turkey must do its best and take this chance forcareful rearrangements to obtain judicial independence and impartiality in judicialsystem.
