| dc.description.abstract | ÖZET “Kolektif Yatırım SözleĢmesi” konulu tezimizin giriĢ bölümünde, genel olarak yatırım fonu kavramı incelenmiĢ, geliĢmiĢ ülkelerde ve ülkemizde yatırım fonlarının kuruluĢu ve geliĢimi ile ilgili bilgiler verilerek, yatırım fonlarının kuruluĢ amacı açıklanmıĢtır. Tezin ilk bölümünde, yatırım fonlarının tarafları tanıtılarak bunların görevlerine değinilmiĢ, daha sonra bunların aralarındaki hukuki iliĢkiler kapsamında yatırım fonu çerçevesinde akdedilen sözleĢmeler hakkında bilgi verilmiĢtir. Bu bölümde tez konumuzu oluĢturan kolektif yatırım sözleĢmesinin konusu ve kuruluĢu ile sözleĢmenin devri konusu açıklanmıĢtır. Tezin ikinci bölümünde, kolektif yatırım sözleĢmesinin özellikleri belirtilerek, sözleĢmenin hukuki niteliği ve sözleĢmeye uygulanacak hükümlerle ilgili doktrindeki tartıĢmalara yer verilmiĢ olup, fon içtüzüğü hakkında bilgi verilmiĢ, fon içtüzüğünün hukuki niteliği tartıĢılmıĢ ve fon içtüzüğü ile kolektif yatırım sözleĢmesi arasındaki iliĢki incelenmiĢtir. Tezin üçüncü bölümünde, kolektif yatırım sözleĢmesinin hüküm ve sonuçları incelenmiĢ ve katılma belgesi sahibinin hakları ve borcu açıklanmıĢ olup, sözleĢmenin sona erme halleri irdelenmiĢtir. Sonuç bölümünde ise tezde inceleme konusu yapılan konulara ve tartıĢmalı hususlara iliĢin olarak katıldığımız görüĢler, ana hatları ile özetlenmeye çalıĢılmıĢtır. ABSTRACT In the introduction section of our thesis themed “Collective investment act”, the concept of investment fund is handled in general terms; information is given on establishment and development of investment funds in developed countries and in our country and establishment purpose of investment funds is explained. In the first section of the thesis, parties of investment funds are introduced, their duties are mentioned and afterwards, information is given about the acts signed in the framework of investment fund within the scope of the legal relationships among them. In this section, subject and establishment of collective investment act, which constitutes the subject of our thesis and the issue of contract transfer are explained. In the second section of the thesis, properties of collective investment contract are indicated; legal quality of the contract and discussions in the doctrine about the provisions to be applied to the contract are included; information is given about the fund bylaws, legal quality of the fund bylaws is discussed and the relation between fund bylaws and collective investment act is examined. In the third section of the thesis, provisions and conclusions of collective investment act are handled; rights and debt of the participation certificate bearer is declared and termination conditions of act are addressed. In the conclusions section, the opinions we agreed upon with regard to the subjects addressed in the thesis and controversial issues are tried to be summarized generally. | |
