   <dim:field mdschema="dc" element="description" qualifier="abstract" lang="tr_TR">Uluslararası deniz ticaretinde temiz konişmento kavramına, sadece konişmento hamili ile taşıyan arasındaki taşıma hukukunu ilgilendiren hukuki ilişki içinde değil, CIF, FOB, CFR kaydı ile akdedilen yüklemede satış mahiyetindeki denizaşırı satış sözleşmeleri ve bu sözleşmelerde ödeme şekli olarak seçilen akreditif bakımından da başvurulmaktadır. Yüklemede satışlarda satın aldığı malı bizzat görmek ve incelemek fırsatı olmayan kimseler, eşya henüz denizde taşınmakta iken temiz konişmentonun ibraz edilmesi karşılığında satış bedelini ödemektedirler. Ödemenin akreditif ile yapılmasının kararlaştırıldığı durumda da banka kendisine temiz konişmento ibraz edilmesi karşılığında ödeme yapmaktadır. Uygulamada temiz konişmento tanımına ulaşmak için bir ölçüt olarak konişmentolarda önceden basılı "dış görünüm olarak iyi hal ve durumda yüklenmiştir" kaydından yararlanılmaktadır. Taşıyan konişmentodaki bu beyanı ile eşya veya ambalajının makul bir şekilde incelenip denetlendiğini ve bir ayıp ya da eksiklik tespit edilmediğini açıklamaktadır. Ancak eşyanın dış görünümünde bir ayıp ya da miktarında eksiklik tespit edilmişse, uygulamada genellikle "marjinal kayıtlar" olarak ifade edilen çekinceler, taşıyan tarafından konişmentoya eklenmektedir. Konişmentoya marjinal kayıt eklenmesinin sonucu, konişmentonun temiz statüsünü kaybetmesidir. Ancak günümüzde temiz konişmento hakkında mevzuatta ve öğretide yapılmış kesin bir tarife ulaşılamamıştır. Gerek denizde eşya taşıma sözleşmesi gerekse denizaşırı satış sözleşmeleri ve akreditif ile ödeme şeklinde aynı kavramın kullanılması, "temiz konişmento"nun farklı biçimlerde tanımlanmasını önleyememiştir. Bu nedenle temiz konişmento hakkında yeknesak bir tanım oluşturulmalı, hem denizde eşya taşıma sözleşmesi hem UCP ve Incoterms bakımından temiz konişmento içeriği birbiri ile tutarlı olmalıdır. Akreditif bankasından ödeme elde etmek isteyen yükleten sık sık taşıyana garanti mektubu teklifinde bulunarak onun temiz konişmento düzenlemesinden doğan her türlü sorumluluğu sebebi ile uğrayacağı zararı tazmin etmeyi taahhüt etmektedir. Çünkü yükletenin teklif ettiği garanti mektubu karşılığında taşıyanın düzenlediği temiz konişmento, genellikle eşya veya ambalajı hakkında yanlış bilgiler içeren gerçeğe aykırı bir konişmentodur ve bu konişmentoyu düzenlemesi taşıyanın sorumluluğunu doğurmaktadır.</dim:field>
   <dim:field mdschema="dc" element="description" qualifier="ozet" lang="tr_TR">The concept of a clean bill of lading in international maritime trade is not only used in the legal relationship concerning the law of carriage of goods by sea between holder of bill of lading and carrier, but also in shipment sale contracts concluded on CIF, FOB, CFR terms and letter of credit chosen as a form of payment in these contracts. In shipment sales buyers, who do not have the opportunity to see and examine the goods they have bought, pay the price for the goods, which are still being transported at sea, in return of presentation of clean bill of lading. In the case where the payment is agreed to be made with the letter of credit, the bank also makes the payment only if clean bill of lading is tendered to him. In practice as a criterion for reaching the definition of clean bill of lading, a pre-printed statement as "shipped in apparent good order and condition" has been used in the bill of lading. The carrier explains with this statement that the goods or their packagings have been examined and inspected reasonably and that there has been determined no fault or deficiency. However, if a fault on apparance of the goods or lack on their quantities is determined, reservations which are usually named as "marginal clauses" are included in the bill of lading. The result of including marginal clause in the bill of lading is that bill of lading ceases to be clean. However today there is still no precise definition about clean bill of lading in legislation and doctrine. Even the same concept has been used in contracts of carriage of goods by sea, shipment sale contracts and letter of credit as a payment form, it could not have been prevented the clean bill of lading to be defined in different forms. Therefore a uniform definition of clean bill of lading should be created and it should be ensured that content of clean bill of lading is consistent with the contract of carriage of goods by sea, Incoterms and UCP. In order to get payment from bank, shipper often offers the carrier a letter of indemnity and by this letter of indemnity he undertakes that he will compensate the carrier for any responsibility arising from having issued of clean bill of lading. Clean bill of lading that has been issued in return of letter of indemnity is generally a bill of lading which includes wrong information about the goods and their packagings. Because of that this bill of lading issued contrary to facts causes carrier's responsibility.</dim:field>
