Abstract
This thesis provides a comprehensive analysis of repeating trademark applications and evergreening strategies as manifestations of bad faith in trademark law, with a particular focus on the Turkish legal system. The study highlights how these practices exploit gaps in legislative and procedural frameworks to circumvent genuine use requirements, artificially extend trademark protection, and undermine fair competition and consumer confidence. Through a comparative legal analysis involving the EU, U.S., and China, the thesis demonstrates that while the EU and Türkiye suffer from similar deficiencies—primarily the absence of explicit legal safeguards against such abusive filings—the U.S. and China have adopted more effective mechanisms, notably through stricter use requirements and legislative amendments. The research underscores the urgent need for Türkiye to introduce explicit statutory provisions, strengthen administrative practices, and promote judicial consistency to address these systemic vulnerabilities. Ultimately, the thesis aims to contribute to the development of a more robust and equitable trademark protection system that better serves both private and public interests.
Bu tez, marka hukukunda kötü niyetin bir tezahürü olarak karşımıza çıkan tekrar eden marka başvuruları ve evergreening stratejilerini kapsamlı bir şekilde incelemektedir ve özellikle Türk hukuk sistemine odaklanmaktadır. Çalışmada, bu uygulamaların yasal ve usule ilişkin boşluklardan yararlanarak ciddi kullanım şartını aşmak, marka korumasını yapay biçimde uzatmak ve adil rekabet ile tüketici güvenini zedelemek suretiyle sistemi istismar ettiği ortaya konulmaktadır. AB, ABD ve Çin hukuk sistemlerinin karşılaştırmalı incelemesi yoluyla, AB ve Türkiye'nin bu alandaki ortak zaaflarının—özellikle kötü niyetli başvurulara karşı açık yasal güvencelerin eksikliğinin—altı çizilirken; ABD ve Çin'in daha etkili çözümler sunduğu, özellikle sıkı kullanım şartları ve yasal değişiklikler sayesinde bu tür suistimalleri daha iyi engelleyebildiği gösterilmektedir. Araştırma, Türkiye'nin kötü niyetli başvurulara karşı açık yasal hükümler getirmesi, idari uygulamaları güçlendirmesi ve yargısal tutarlılığı sağlaması gerektiğini vurgulamaktadır. Sonuç olarak, tez hem özel hem de kamusal menfaatlere daha iyi hizmet edecek daha güçlü ve adil bir marka koruma sisteminin gelişimine katkı sunmayı hedeflemektedir.
