Abstract
Every individual should be able to find the opportunity to exercise their innate basic human rights in order to improve their possibilities. In modern society, the protection of fundamental rights is the responsibility of the constitutional state. In the constitutional state, human rights must be protected aganist everyone, and especially aganist the state itself. In the trials aganist possible human rights violations, a safeguard is needed for this. This assurance is the right to a fair trial, and the most important element required for the effective use of this assurance is the right to defense. The right to defense is a need that provides the opportunity to combat human rights violations. Although the right to a fair trial and the right to defense, which is an element of this right, are regulated in international law and Turkish law, this right is systematically violated by many countries and our country. In this sense, in this study, the right to defend oneself in person or with the help of a lawyer, which is an element of the right to a fair trial, has been examined, starting from its historical process, by revealing its elements and the decisions given in international law against violations.
