ÖZETHukuk kuralları yoruma gereksinim duyan kurallardır ve bu sebeple bukuralların yorumlanması gerekmektedir. Hukukta yorum ise teknik bir konu olarakkabul edilmiş ve bu konuda birtakım teknik ve yöntemler geliştirilmiştir. Anayasayauygun yorum da anayasa hukuku alanında Anayasa Mahkemelerince geliştirilmiş biryorum tekniğidir.Anayasaya uygun yorum ilkesi ya da yorumlu ret kararları kısaca, anayasayauygun ya da aykırı alternatif yorumlar içeren bir norm karşısında Mahkeme’nin,korunan anlam ya da yorum, ilgili kanun hükmünü bozmuyorsa normu koruyananlamı izlemesi biçiminde tanımlanmaktadır.Anayasaya uygun yorum ilkesi yeni bir ilke ve yeni bir uygulama değildir.Buna karşın doktrinde bu yorum ilkesinin niteliği ve sonuçları üzerinde yoğuntartışmalar yapılmaktadır.Tartışmaların odak noktasını Anayasa Mahkemesi’nin, anayasada somutolarak yer almayan bir karar türü olan yorumlu ret kararı verip veremeyeceği sorunuoluşturmaktadır. Bu soruya verilecek cevaba göre de diğer tartışmalar; yorumlu ret kararlarının yasama ve yargı organları karşısındaki bağlayıcılığı ile karargerekçelerinin bağlayıcı olup olmadığı tartışmaları yapılmaktadır.Anayasa yargısının görevi yalnızca anayasanın diğer devlet organlarıtarafından şekil açısından gözetilmesini denetlemek olarak anlaşılamaz. AnayasaMahkemeleri, anayasayı yorumlarlar ve bununla anayasayı donmuş bir metinolmaktan çıkararak yaşayan anayasa haline sokarlar. Devlet organları ve bütün kişi ve kurumlar, Anayasa Mahkemelerince verilenyorumlu ret kararlarını görmezden gelemezler. Aksine bir tutum, Anayasanın 2., 11.ve 153.maddelerine aykırılığı gündeme getirecektir. Gerek 1961 Anayasası’nda gerekse 1982 Anayasası’nda anayasaya uygunyorum ilkesine açıkça yer verilmemiştir; ancak Anayasa Mahkemesi, söz konusuilkeyi, anayasanın üstünlüğü ve bağlayıcılığı ilkesinin bir uzantısı olarak kabulettiğinden, her iki Anayasa döneminde bu ilkeyi kararlarına yansıtmıştır ve hala dayansıtmaktadır. Fakat söz konusu ilkenin ve bunun yanında yorumlu ret kararlarındagerekçenin bağlayıcılığının anayasa değişikliği ile anayasaya eklenmesi yaşanantartışmaları ve özellikle anayasa yargısının ve Anayasa Mahkemesi’ninmeşruiyetinin sorgulanmasını bir ölçüde sona erdirecektir.ABSTRACTLegal rules are the laws which require interpretation; accordingly, these rulesnecessitates to be interpreted. As for that, interpretation on law accepted as atechnical issue and a number of techniques and methodologies are developed.Interpretation in conformity with the constitution is a technique which has beendeveloped by the Constitutional Courts in the field of constitutional law, as well. Briefly, the principle of interpretation in conformity with the constitution isidentified as to be attributed meaning to the preserving the norm of the court in viewof a norm which includes alternative interpretations with justifiable or unjustifiableexplanations, as long as the relevant law which preserves the norm does not reverse ajudgment.The principle of interpretation in conformity with the constitution is neither anultimate principle nor a new technique. Despite that, there are intense discussions onthe fact and the results of this interpretation principle according to the jurisprudence. The issue, focal point of the discussions, is whether the Constitutional Courtgives a interpretative judgment which is not tangibly involved in constitution or not.With respect to the answer upon this issue, and other discussions; namely, about theinterpretative judgment and rescripts are argued on whether of binding force in viewof judicial bodies or not. The responsibility of the constitutional judgment is understood not only as theviewing of regarded by the other governmental bodies in terms of modality. Constitutional Courts interpret the constitution and herewith, they changeover theconstitution as living by recovering it from being a frozen text. Governmental bodies and the whole individuals and institutions can not ignorethe interpretative judgments which are determined by Constitutional Courts. Abehavior to the contrary brings up unconstitutionality to the 2nd, 11thand the 153rdarticles of the Constitution. Both in the Constitution of 1961 and the Constitution of 1982, the principle ofinterpretation in conformity with the Constitution was not considered obviously;however, since Constitutional Courts have accepted principle in question is thecontinuation of supremacy and binding force and of the Constitution, in bothlegislative periods, from now on, they have shifted this principle to their judgments.However, the entry into force of Constitution of the principle in question and alsobinding force of rescripts on interpretative judgment with the Constitutionalamendment will close the current arguments and especially query on Constitutionallegitimacy of Constitutional Judgment and Court in some extend.
